SMALL BUSINESS SHOWCASE CONTEST

THIS CONTEST IS OPEN ONLY TO FOR-PROFIT SMALL BUSINSSESS LOCATED AND PRIMARILY OPERATED IN THE PROVINCE OF MANITOBA

  1. Sponsor. The Small Business Showcase Contest (the “Contest”) is sponsored by the Winnipeg Football Club located at IG Field, 315 Chancellor Matheson Road, Winnipeg, Manitoba, R3T 1Z2 (“WFC”) and Manitoba Chambers of Commerce located at 550-201 Portage Avenue, Winnipeg, Manitoba, R3B 3K6 (“MCC” and together with WFC, the “Sponsors”).
  2. Eligibility. This Contest is only open to Small Businesses (as defined below) that are located in and primarily operate in the Province of Manitoba. An owner or authorized personnel of the Small Business who is at least eighteen (18) years old may submit the Entry Materials (as defined below) on behalf of the Small Business; noting however that the Small Business and not the person submitting an entry on its behalf is the entrant to the Contest. “Small Business” is defined as a for-profit business that is currently active, operating lawfully, including having all necessary and required licenses and registrations, and have no more than fifty (50) full-time permanent employees, and does not exceed $10,000,000 in annual revenue as of the start date of the Contest and does not operate within the industries that are prohibited by or inconsistent with the Sponsors’, its affiliates and/or related entities’, including for WFC the Canadian Football League’s, guidelines or policies.

    Employees of the Sponsors, their respective parent, related and affiliated companies and subsidiaries, and member clubs (as applicable) and the each of their prize suppliers, advertising and promotional agencies, agencies, contest administrators, and any other parties engaged in the development, production or distribution of Contest materials, and those living in the same household (whether related or not) are not eligible to enter or participate in this Contest.

    By participating in this Contest, entrants acknowledge compliance with, and agree to be bound by, these Contest Rules. Entrants who do not comply with any of the Contest Rules are subject to disqualification by the Sponsors, in Sponsors’ sole discretion.

  3. Contest Dates and Times. The Contest begins on March 17, 2022 at 10:00:00 a.m. central time (“CT”) and ends on April 7, 2022 at 11:59:59 p.m. CT (the “Contest Period”) after which time the Contest will be closed and no further entries will be accepted.
  4. How to Enter

    NO PURCHASE NECESSARY.

    During the Contest Period, you can earn one (1) entry into the Contest by visiting https://www.bluebombers.com/small-business (the “Website”) and follow the on-screen instructions. You must fill out the entry form completely including but not limited to (collectively, the “Entry Materials”): (i) name of the Small Business, (ii) name of the person entering on behalf of the Small Business, address, email address, telephone number and postal code; (iii) confirm that the entrant meets the definition of Small Business; (iv) confirm your agreement to these Contest Rules; (iv) solely at your option, opt-in to receive information and promotional offers from the Sponsors’; and (v) answer the following questions:

    • Provide a brief description of your Small Business;
    • How does your business make an impact on the community?
    • How would your company benefit from winning a sponsorship with the Winnipeg Blue Bombers?
    • What product or service would your business be advertising in a marketing campaign if selected as the winner of this promotion? and
    • Where did you hear about the contest?

    Your consent for communications can be withdrawn at any time after you have been contacted. Opting in to such communications is not required to enter the Contest and does not impact an entrant’s odds of winning.

    When all required steps on the Website entry process are complete, you have earned one (1) Entry in the Contest.

    There is a limit of one (1) entry per Small Business and email address. Your only method of entry is by the Website and no other methods of entry will be accepted. If it is discovered by the Sponsors (using any evidence or other information made available to or otherwise discovered by the Sponsors) that any person has attempted to: (i) obtain more than one (1) Entry; and/or (ii) use multiple names, multiple identities, multiple accounts, any automated, macro, script, robotic or other system(s) or program(s), and/or any other means not in keeping with the Sponsors’ interpretation of the letter and spirit of these Contest Rules to enter or otherwise participate in or to disrupt this Contest; then he/she/it may be disqualified from the Contest in the sole and absolute discretion of the Sponsors. The Released Parties (as defined in Section 10 below) are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed, incomplete or incompatible entries and/or Entry Materials (all of which are void).

    An entry may be rejected if, in the sole and absolute discretion of the Sponsors: (i) the entry (including, but not limited to, any associated Entry Materials) is not submitted and received in accordance with these Contest Rules during the Contest Period; and/or (ii) the Entry Materials accompanying the entry are not in compliance with these Rules (including, but not limited to, the specific Submission Requirements listed below in Section 6) (all as determined by Sponsors in their sole and absolute discretion).

    In the event of a dispute regarding any entry submitted, the authorized account holder of the email address used to register will be deemed to be the person who is authorized to act on behalf of the Small Business. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being an authorized account holder.

  5. Verification.
    All entries, Entry Materials and entrants are subject to verification at any time and for any reason. The Sponsors reserve the right, in their sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsors – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest on behalf of a Small Business; (ii) for the purposes of verifying the eligibility and/or legitimacy of any entry, Entry Materials and/or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsors deem necessary, in their sole and absolute discretion, for the purposes of administering this Contest in accordance with the Sponsors’ interpretation of the letter and spirit of these Contest Rules. Failure to provide such proof to the complete satisfaction of the Sponsors within the timeline specified by the Sponsors may result in disqualification in the sole and absolute discretion of the Sponsors. The sole determinant of the time for the purposes of this Contest will be the official time-keeping device(s) of the Sponsors.
  6. Submission Requirements.
  7. BY SUBMITTING AN ENTRY, YOU AGREE THAT THE ENTRY (AND EACH INDIVIDUAL COMPONENT THEREOF – INCLUDING, WITHOUT LIMITATION, THE ENTRY MATERIALS) COMPLIES WITH ALL CONDITIONS STATED IN THESE CONTEST RULES. THE RELEASED PARTIES WILL BEAR NO LIABILITY WHATSOEVER REGARDING: (I) THE USE OF YOUR ENTRY (OR ANY COMPONENT THEREOF – INCLUDING, WITHOUT LIMITATION, THE ENTRY MATERIALS); (II) PARTICIPATION IN ANY CONTEST-RELATED ACTIVITIES; (III) ANY USE, COLLECTION, STORAGE AND DISCLOSURE OF ANY PERSONAL INFORMATION; AND/OR (IV) IF DECLARED A WINNER, THE PRIZE (INCLUDING ANY USE OR MISUSE OF A PRIZE). THE RELEASED PARTIES SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT OTHERWISE FULLY COMPLIED WITH ANY OF THESE CONTEST RULES AND THIS RELEASE AND INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE CONTEST AND/OR AWARDING OF ANY PRIZES.

    By participating in the Contest, each entrant hereby warrants and represents that any Entry Materials he/she submits:
    i. is/are original to him/her and/or that the entrant has obtained all necessary rights in and to the Entry Materials for the purposes of entering such Entry Materials in the Contest;
    ii. does not violate any law, statute, ordinance or regulation; and
    iii. will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party.

    The Sponsors and/or its promotional agency or designated content moderator (the “Reviewer”) reserve the right to screen all Entry Materials. Any Entry Materials that the Reviewer deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Rules are subject to disqualification. The Reviewer reserves the right, in its sole and absolute discretion at any time and for any reason, to remove any Entry Materials (or any part thereof) where possible and/or to request an entrant to modify, edit and/or re-submit his or her Entry Materials (or any part thereof) in order to ensure that the Entry Materials comply with these Contest Rules, or for any other reason. If such an action is necessary at any point during or after the Contest, then the Sponsors reserve the right, in their sole discretion, to take whatever action it deems necessary based on the circumstances – including, without limitation, disqualifying the Entry Materials (and therefore the corresponding entry and/or the associated entrant) – to help ensure that the Contest is being conducted in accordance with the Sponsors’ interpretation of the letter and spirit of these Rules.

  8. Finalist Selection and Prizes.
    There are a total of six (6) prizes available to be won.
    Five (5) finalists (each a “Finalist”) will be selected by the Sponsors’ executives at their sole discretion based on the answers to the questions provided in the Entry Materials to the following judging criteria:

    • Completion of application;
    • Depth of community involvement;
    • Worthiness of business and brand; and
    • Business and sponsorship category a good fit to partner with the Winnipeg Blue Bombers.

    The five (5) selected finalists will be invited to submit a two-minute pitch video of why their company is the most deserving small business to be awarded the grand prize.

    Each of the five (5) Finalists will receive a $250 Bomber Store Gift Card and a custom Blue Bombers jersey with the Small Business’ name – approximate retail value per prize is $450.00.

    There is one (1) grand prize for the selected Small Business winner consisting of the following sponsorship prizing. Approximate retail value of the grand prize is $50,000:

    • Video board logo advertising in-stadium for the 2022 Blue Bomber Season (five minutes of time, in 15 second increments);
    • 100,000 website ad impressions on bluebombers.com;
    • Spotlight article on bluebombers.com with company logo, business description and link to business website. A link to the article will be posted on Blue Bombers social media channels; and
    • Five (5) custom Blue Bombers jerseys with the small business name on the back of the jersey along with the number 22 to represent the year the prize was won.

    Advertisement placements and dates of publication for the grand prize will be determined by the Sponsors in their sole discretion.

    All winners assume any and all liability for any injury or damage caused, or claimed to be caused, by entering and/or participating in this Contest or the use or redemption of a prize. Prizes must be accepted as awarded and is not transferable and have no cash value and cannot be convertible into cash. Lost or stolen prizes will not be replaced by the Sponsors. Prizes are provided “as is” without further warranty, representation, condition, or guarantee, express or implied, of any kind. Prizes or any portion of a prize cannot be combined with other discounts, promotions or special offers. Sponsors reserves the right to substitute an alternate prize of equal or greater value if an advertised prize is unavailable at the time of award. The actual value of the prizes described above depends on market conditions at time of fulfilment. Any difference between stated Approximate Retail Value and actual value of prize will not be awarded. All prize details not specified herein are at Sponsor’s sole discretion. The Sponsors reserves the right at any time to place reasonable restrictions on the availability or use of the Prize or any component thereof. By accepting prize, the selected entrant agrees to abide by any terms, conditions and restrictions placed on the prizes provided by the Sponsors.

    The Released Parties are not responsible for any delay, postponement, suspension, rescheduling or cancellation, for any reason, of any aspect of a Prize – including, but not limited to games. Neither the confirmed winners nor any other person or entity will be compensated in the event of such delay, cancellation or other event contemplated herein.

    None of the Released Parties makes any representation or offers any warranty, express or implied, as to the quality or fitness of the Prize awarded in connection with the Contest. To the fullest extent permitted by applicable law, the confirmed winner understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsors or any of the other Released Parties should his/her Prize fail to be fit for its purpose or is in any way unsatisfactory.

  9. Odds of Winning. The odds of winning depend on the number of eligible entries received during the Contest Period and the entrant’s responses to the questions in the Entry Materials in relation to the judging criteria at the Sponsors’ sole discretionary.
  10. Finalists and Winner Selection and Confirmation. On April 18, 2022 at 10:00 a.m. CT (the “Finalist Selection Date”), the five (5) Finalists will be selected and contacted by the Sponsors, or an employee, agent or other representative of the Sponsors by e-mail or telephone call provided at the time of entry into the Contest. It is the sole responsibility of the entrant to ensure their name, e-mail address and telephone number are correct at the time of entry. Up to three attempts will be made to contact the selected Finalists within three (3) business days following the Finalist Selection Date. The Sponsors must receive a response from the selected Finalists within five (5) business days of the first notification attempt and a confirmation from each selected Finalist that they will submit a two-minute pitch video of why their company is the most deserving small business to be awarded the grand prize on or before May 2, 2022.

    On May 11, 2022 at 10:00 a.m. CT (the “Winner Selection Date”), one grand prize winner from the Finalists will be selected and contacted by the Sponsors, or an employee, agent or other representative of the Sponsors by e-mail or telephone call provided at the time of entry into the Contest. Up to three attempts will be made to contact the selected grand prize winner within five (5) business days following the Winner Selection Date. The Sponsors must receive a response from the selected grand prize winner within seven (7) business days of the first notification attempt.

    The Sponsors are not responsible for the failure for any reason whatsoever of a selected Finalist or a selected grand prize winner (each, a “Selected Entrant”) to receive notification or for the Sponsors to receive a Selected Entrant’s response.

    Each Selected Entrant will be eligible to receive their respective prizes if they meet all of the eligibility criteria set out in these Contest Rules. If a Selected Entrant does not meet the eligibility criteria, they will be disqualified and will not receive a prize and, at the sole discretion of the Sponsors and time permitting, another Finalist or grand prize winner, as applicable, may be selected from the remaining eligible entries, time permitting.

    Before being declared a Finalist and/or the winner, as applicable, the Selected Entrants will be required to: (i) sign and return the Sponsors’ Declaration of Eligibility and Liability/Publicity Release form (the “Winner Release”); and (ii) comply with all other Contest Rules, all in the sole discretion of Sponsors. If a Selected Entrant (i) cannot be contacted within the time periods provided in this Section 9; or (ii) does not sign and return the Winner Release; then their prize will be forfeited. A Selected Entrant that does not or cannot accept a prize may be forfeited and a new Selected Entrant selected by the Sponsors’, in their sole discretion, time permitting.

  11. Release and Indemnification. All Finalists and the grand prize winner must sign the Winner Release to: (i) confirm compliance with all Contest Rules; (ii) agree to accept prize(s) as awarded; (iii) release, discharge and hold harmless the Sponsors, their parents, related and affiliated companies, subsidiaries, franchisees, member clubs, advertising and promotional agencies, counsel, marketing partners, and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development and execution of the Contest (collectively, the “Released Parties”) from and against any and all manner of action, cause of action, claim or demand, loss or injury, use or misuse of a prize or any travel related thereto, and the use of entries by the Sponsors, suit, debt, covenant, contract, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach, failure of any third-party contractor or supplier used in connection with any aspect of the Contest to perform or deliver any goods or services, any act of God or any other event beyond the Released Parties’ control, any dissatisfaction of any kind by a Finalist and/or the grand prize winner with any aspect of the Contest or any prize, liability for physical injury, death, or property damage which the entrants, guests, their heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of the entrant’s participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of prizes as awarded; and (iv) indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur as a result of any non-compliance by entrants with any of the Contest Rules or participation in the Contest and/or in connection with the acceptance and/or exercise by an entrant of a prize, and the use of entries by the Sponsors.

    The Released Parties are not responsible for: (i) incorrect or inaccurate entry information that may affect a person’s ability to participate in the Contest or be awarded a prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, mail failures, omission, or any combination thereof, and entries that fail to fully comply with these Contest Rules; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (iii) lost, incomplete, delayed, mutilated or misdirected entries or Winner Releases; (iv) injury or damage to entrants’ computers or to any other individual’s computer related to or resulting from participating in, or downloading any material regarding the Contest or accepting a prize; (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize, including any related travel and the use of entries by Sponsors; (vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third-party computer hackers or otherwise; or (vii) late, lost, misdirected or unsuccessful efforts to notify a potential Finalist and/or grand prize winner.

  12. Other Conditions. The Sponsors reserve the right to terminate or amend this Contest at any time and in any way, without prior notice to entrants. Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned for any reason, including, without limitation, any error, problem, accident, computer virus, bugs, tampering, unauthorized intervention, fraud or failure of any kind, the Sponsors reserve the right to cancel the Contest, in their sole discretion.
  13. Publicity and Entrant Information. By participating in the Contest, entrants consent to the use of their name, Small Business name, address, email address, postal code, telephone number, social media handle(s), comments and image, whether on videotape, photograph or any other means, as applicable, for the administration of the Contest or any publicity carried out by the Sponsors, without further notice or compensation. Further, Acceptance of any prize shall constitute and signify each Finalist and grand prize winner’s agreement and consent that the Sponsors and their designees may use their name, Small Business name, city, province, likeness, Entry Materials and/or prize information in connection with the Contest for promotional, advertising, or other purposes, worldwide, in any and all media now known or hereafter devised, including the Internet, without limitation and without further payment, notification, permission or other consideration, except where prohibited by law
  14. Law. The Contest is void where prohibited by law and is subject to all applicable Canadian federal, provincial, territorial, municipal and local laws. This Contest shall be governed exclusively by the laws of the province of Manitoba, including all issues and questions concerning the construction, validity, interpretation and enforceability of these Contest rules, rights and obligations between entrants and the Sponsors, and procedural provisions, without giving effect to any choice of law or conflict of law rules. Any dispute shall be adjudicated by the courts sitting in Winnipeg, Manitoba.
  15. Privacy. By entering this Contest, each entrant expressly consents to the Sponsors, its agents and/or representatives, storing, sharing and using the personal information, as applicable, submitted for the purpose of administering the Contest and in accordance with WFC’s privacy policy (available at: https://www.bluebombers.com/privacy-policy/). This section does not limit any other consent(s) that an individual may provide the Sponsors or others in relation to the collection, use and/or disclosure of their personal information.
  16. Rule Amendments. The Sponsors reserves the right, in their sole discretion, to amend or modify these Contest Rules, or modify, cancel or suspend this Contest, without prior notice for any reason whatsoever, including without limitation in the event that any cause beyond the reasonable control of the Sponsors corrupts, or threatens to corrupt, the security or proper administration of the Contest.
  17. Intellectual Property. All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations are owned or licensed by the Sponsors. All rights reserved. Unauthorized copying or use of any of the Sponsors’ intellectual property without the express written consent of the Sponsors is strictly prohibited.
